Welcome to Five Twenty Apparel. These Terms of Service (“Terms”) govern your access to and use of the Five Twenty Apparel website at https://fivetwentyapparel.com, and any related services, features, content, and products we offer (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, Return Policy, and Shipping Policy. If you do not agree to these Terms, do not use the Services.
“Five Twenty Apparel,” “we,” “us,” and “our” refer to Five Twenty Apparel, an online apparel brand based in Arizona, United States.

We specialize in apparel and related products, including but not limited to t‑shirts, hoodies, and other clothing items featuring city- and Arizona-inspired designs. We strive to describe and display our products as accurately as possible.
However, we do not warrant that:
- Product descriptions, images, sizing information, or colors are perfectly accurate, complete, or error-free;
- Colors will appear the same on all screens or devices.
3.2 Authenticity & Quality
Five Twenty Apparel emphasizes 100% authentic, high-quality products, backed by our satisfaction commitment. Nevertheless, minor variations may occur in print placement, color shades, and sizing tolerances typical for apparel manufacturing.
3.3 Pricing
All prices are listed in U.S. Dollars (USD) unless otherwise stated. We reserve the right to:
- Change prices without prior notice;
- Correct pricing errors or inaccuracies at any time, even after an order has been placed.
If the correct price of a product is higher than the price at the time of your order, we may contact you for confirmation, or cancel the order and issue a refund.
3.4 Product Availability
All products and offers are subject to availability. We may:
- Limit quantities;
- Discontinue or modify products;
- Restrict orders (e.g., per customer or per household).
If an item is unavailable after you place an order, we may cancel that item and issue a refund for the unavailable portion.

4.4 Order Changes and Cancellations by Customer
Once an order is placed, we begin processing it as quickly as possible. This often limits our ability to change or cancel an order. If you need to modify or cancel an order, contact us immediately. We cannot guarantee that changes or cancellations will be possible after an order is submitted.
5. SHIPPING & DELIVERY
Shipping and delivery terms are further detailed in our Shipping Policy. By placing an order, you agree to those terms.
In summary:
- We ship nationwide within the United States;
- Delivery times are estimates and not guaranteed;
- Risk of loss passes to you when the order is delivered to the carrier.
6. RETURNS, EXCHANGES & REFUNDS
Our Return Policy governs returns, exchanges, and refunds. By making a purchase, you agree to the terms described in that policy.
7. GIFT CARDS AND PROMOTIONS
7.1 Gift Cards
If offered, digital or physical Five Twenty Apparel gift cards:
- Are redeemable only for purchases at https://fivetwentyapparel.com;
- Are not redeemable for cash except where required by law;
- Will not be replaced if lost, stolen, or damaged, except as required by law and at our discretion.
7.2 Promotions and Discounts
We may run promotions, discounts, coupon codes, or loyalty programs. Unless otherwise indicated:
- Promotions cannot be combined;
- Promotions are subject to change or cancellation at any time;
- Additional terms may apply.
8. INTELLECTUAL PROPERTY
8.1 Ownership
All content and materials on the Services, including text, graphics, logos, designs, images, photos, product names, and code (collectively, “Content”), are owned by or licensed to Five Twenty Apparel and protected under applicable intellectual property laws.

- Use, reproduce, modify, adapt, publish, translate, distribute, display, and perform your User Content;
- Use your name, username, or social media handle in connection with your User Content;
in any media now known or later developed, for any lawful purpose including marketing and promotion.
9.3 Your Representations
You represent and warrant that:
- You own or have the necessary rights to your User Content;
- Your User Content does not infringe any third-party rights, violate any law, or contain unlawful, defamatory, or objectionable material.
9.4 Removal of User Content
We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.
10. ACCEPTABLE USE
You agree not to use the Services to:
- Violate any law, regulation, or these Terms;
- Interfere with or disrupt the security or operation of the Services;
- Attempt to gain unauthorized access to any accounts, systems, or networks;
- Upload or transmit viruses, malware, or other harmful code;

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ALL IMPLIED WARRANTIES OF:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- TITLE;
- NON-INFRINGEMENT;
AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, FIVE TWENTY APPAREL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES,
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR
- ONE HUNDRED U.S. DOLLARS (US $100).
15. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Five Twenty Apparel and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use or misuse of the Services or products;
- Your violation of these Terms;
- Your violation of any rights of another person or entity;
- Your User Content.
16. GOVERNING LAW & DISPUTE RESOLUTION
16.1 Governing Law
These Terms and your use of the Services are governed by the laws of the State of Arizona, without regard to its conflict of laws principles.
16.2 Informal Resolution
Before initiating any formal dispute, you agree to contact us and attempt to resolve the matter informally.
16.3 Venue
Subject to any applicable arbitration or small claims provisions under Arizona or U.S. law, you agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction and venue of such courts.
(Note: If you want binding arbitration / no class actions, you can add that, but it is wise to have an Arizona attorney tailor that section.)
17. TERMINATION
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will cease immediately. Sections that by their nature should survive termination will remain in effect.
18. CHANGES TO TERMS AND SERVICES
We may update or modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
We may modify, suspend, or discontinue any part of the Services at any time without liability.
